1. Agreement to Terms

By accessing and using the SnapEasy service ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

SnapEasy is a web-based service that allows users to upload their Snapchat memories export file (memories_history.html) for EXIF tagging, date organization, and file naming. The service processes your file and provides you with organized output.

3. User Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Promptly notifying us of unauthorized access
• Ensuring you have the right to use the content you upload
• Complying with all applicable laws and regulations

4. Acceptable Use Policy

You agree not to use SnapEasy to:

• Upload files that are not your own Snapchat memories export
• Violate any applicable laws or regulations
• Attempt to gain unauthorized access to the Service
• Transmit malware, viruses, or malicious code
• Harass, threaten, or defame others
• Interfere with the Service's operation or security
• Attempt to reverse-engineer or circumvent security measures
• Use the Service for commercial purposes without authorization

5. Intellectual Property Rights

SnapEasy and its contents (including but not limited to code, design, text, and graphics) are the exclusive property of SnapEasy and its content suppliers and are protected by international copyright and trademark laws.

You retain all rights to the content you upload (your memories). We grant you a limited license to use the Service to process your own memories for personal use.

6. Payment Terms

• Payment Processing: All payments are processed through Stripe. We do not handle credit card information directly.
• Pricing: Pricing is displayed before purchase and subject to change with 30 days' notice
• Refund Policy: Refunds are available within 30 days of purchase if you are not satisfied with the service. Contact [email protected] to request a refund.
• Recurring Charges: Subscription charges will recur on the date specified during checkout
• Cancellation: You may cancel your subscription at any time through your account settings

7. Data Handling and Deletion

Automatic Deletion: Your uploaded memories_history.html file and all associated processed data are automatically deleted within 48 hours of upload. We do not retain backups of your files after this period.

User Deletion Rights: You may request immediate deletion of your data at any time before the 48-hour period expires by contacting [email protected].

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MEMOREASY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF MEMOREASY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL MEMOREASY'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU IN THE PAST 12 MONTHS FOR THE SERVICE.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. MEMOREASY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

MEMOREASY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Indemnification

You agree to indemnify, defend, and hold harmless SnapEasy and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your uploaded content or data

11. Termination

SnapEasy reserves the right to terminate your account and access to the Service at any time, with or without cause, with or without notice. Upon termination, all data associated with your account will be deleted within 48 hours.

12. Changes to Terms

SnapEasy reserves the right to modify these Terms of Service at any time. Changes will be effective upon posting to the website. Your continued use of the Service constitutes acceptance of the updated Terms.

We will provide notice of material changes via email or through the Service.

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles.

14. Dispute Resolution

Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association (AAA) rules, except that either party may seek equitable relief in court.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will remain in effect.

16. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and SnapEasy concerning the Service and supersede all prior agreements and understandings.
